Terms of service

Welcome to Coast Cali. These Terms of Service ("Terms") govern your access to and use of the Coast Cali website (www.coastcali.com.au) and the products and services we offer through it. Coast Cali is operated from Australia by [Coast Cali Pty Ltd / Coast Cali] (67 690 195 861).
By accessing or using the Site, placing an order, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or Services.
Nothing in these Terms limits your rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot be excluded. Where any part of these Terms is inconsistent with those rights, those rights prevail to the extent of the inconsistency.
1. Eligibility and your account
If you create an account, you are responsible for keeping your login details secure and for all activity that occurs under your account. Please contact us promptly if you believe your account has been used without your authorisation.
2. Use of the Site and Services
We grant you a limited, non-exclusive, non-transferable and revocable licence to access and use the Site and Services for your own personal, non-commercial purposes. You agree not to reproduce, duplicate, copy, sell, resell, scrape, or otherwise exploit any part of the Site or Services for a commercial purpose without our express written consent. You also agree not to interfere with the security or proper working of the Site, or use it in a way that breaches any law.
All content on the Site — including text, graphics, logos, images, and the "Coast Cali" name and branding — is owned by or licensed to Coast Cali and is protected by intellectual property laws. Nothing in these Terms transfers any of those rights to you.
3. Products, pricing and GST
We try to describe and display our products as accurately as possible, but colours, sizes and details may vary slightly from what appears on your screen. Products are subject to availability, and we may limit quantities or discontinue a product at any time.
All prices are shown in Australian dollars (AUD) and, where applicable, are inclusive of GST. Prices are subject to change, but the price that applies to your order is the price displayed at the time you place it. Delivery costs, where they apply, are shown separately at checkout before you pay.
We take care to ensure pricing is correct. If we discover a genuine error in the price of something you have ordered, we will contact you before dispatch to let you choose between confirming the order at the correct price or cancelling it for a full refund.
4. Orders and payment
When you place an order, you are making an offer to purchase. Your order is accepted, and a contract is formed, when we send you an order confirmation or dispatch the goods, whichever happens first. We may decline or cancel an order — for example, if the item is out of stock, if there was a pricing error, or if we suspect fraud — and if we do, we will refund any payment you have already made for that order.
We accept payment by the methods shown at checkout. You confirm that you are authorised to use the payment method you provide. Payments are processed by third-party payment providers, and their terms and privacy practices also apply to your transaction.
5. Promotions and discount codes
From time to time we run promotions, such as the Black Friday Early Access offer. Unless stated otherwise: promotional discounts cannot be combined with other offers; the Black Friday Early Access offer provides 25% off all products and excludes items that are already discounted, including discounted bundles; and each promotion may have its own start and end date, eligibility conditions and exclusions, which we will make clear at the time. We may vary, suspend or end a promotion at any time, though changes will not affect orders already placed and accepted.
6. Shipping and delivery
We deliver to the areas shown at checkout. Estimated delivery times are estimates only and are not guaranteed. Risk in the goods passes to you on delivery to the address you provide. If your order arrives damaged or does not arrive within a reasonable time, please contact us so we can help — this is separate from, and in addition to, your rights under the Australian Consumer Law.
7. Returns, refunds and your consumer guarantees
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
In addition to those rights, we offer a change-of-mind returns policy: you may return eligible items within [insert number] days of delivery, provided they are unused, in original condition and with tags and packaging intact. Change-of-mind returns may exclude certain items (for example, sale items, final-sale bundles, or hygiene-sensitive products), and return shipping for change-of-mind returns is at your cost. Approved refunds are made to your original payment method within a reasonable time after we receive and inspect the returned goods.
8. User content
Parts of the Site may let you submit content such as reviews, comments, ratings and images ("User Content"). You keep ownership of your User Content. By submitting it, you grant Coast Cali a non-exclusive, royalty-free, worldwide, transferable and sub-licensable licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and display that content in connection with our business and its promotion, across any media.
You confirm that your User Content is your own or that you have the right to submit it, and that it will not: infringe the intellectual property, privacy or other rights of anyone else; be false, misleading or deceptive; promote unlawful activity; harass, bully, threaten or defame any person; or otherwise breach any law. We may remove or edit User Content that we reasonably consider breaches these Terms or is otherwise objectionable or unlawful, but we are not obliged to monitor User Content.
9. Privacy
We handle your personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth) and Australian Privacy Principles. 10. Third-party links
The Site may contain links to third-party websites or services that we do not control. We provide those links for convenience only and are not responsible for the content, products or practices of third parties. Your use of a third-party site is governed by that site's own terms.
11. Disclaimers
We provide the Site on an "as is" and "as available" basis. To the extent permitted by law, we do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components. This clause does not exclude, restrict or modify any consumer guarantee, right or remedy that applies to you under the Australian Consumer Law or any other law and that cannot lawfully be excluded.
12. Limitation of liability
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
Where our liability for a failure to comply with a consumer guarantee can lawfully be limited, our liability is limited (at our option) to, in the case of goods, replacing or repairing the goods or paying the cost of doing so; and in the case of services, resupplying the services or paying the cost of doing so.
Subject to the above, and to the extent permitted by law, Coast Cali will not be liable for any indirect, incidental, special or consequential loss arising out of or in connection with the Site or Services, and our total liability arising out of or in connection with your order is limited to the amount you paid for the relevant products or Services.
13. Indemnity
To the extent permitted by law, you agree to indemnify Coast Cali against any claims, liabilities, costs and losses arising from your breach of these Terms, your misuse of the Site or Services, or your infringement of another person's rights. This does not apply to the extent the loss was caused by our own negligence or breach.
14. Suspension and termination
We may suspend or terminate your access to the Site or Services if you breach these Terms or where we reasonably need to for legal, security or operational reasons. Where practical and appropriate, we will give you notice. Termination does not affect any order already accepted, any payment obligations, or any rights and remedies that have already accrued. Clauses that by their nature should survive termination (such as those on intellectual property, liability and indemnity) will continue to apply.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will post the updated version on the Site and change the "Last updated" date above. Changes are not retrospective and will not affect orders already placed and accepted. Your continued use of the Site after an update takes effect means you accept the revised Terms, so we encourage you to review them periodically.
16. Governing law
These Terms are governed by the laws of [insert your State/Territory, e.g. New South Wales], Australia, and you and Coast Cali submit to the non-exclusive jurisdiction of the courts of that State/Territory and the Commonwealth of Australia.
